Supreme Court Ruling of 3% Health Care Contribution FAQ

The Business Office and the Superintendent’s Office will not be taking calls or responding to emails regarding the Supreme Court’s ruling on the 3% health care refund. We estimate over 800 current or former Clio employees are affected by the decision: we simply do not have the resources to respond to everyone and to continue with our current job responsibilities.


We will update the FAQ’s on a regular basis. If you have a question or a concern that is not on our list, please leave a message at and we will respond. Thank you for your understanding and patience.

Checks will be printed on March 9.  Current employees will receive their checks at work that day.  Checks for former employees will be mailed that day.

What if the amount ORS has indicated I am to be refunded does not match my calculations?  The answer is:  Contact the Office of Retirement Services at 800-381-5111 or send an email through your Mi-Account.

Important Information About Receiving Information
We at ORS want you to stay in-the-loop about important things that are happening. The beginning of the year is a great time to log in to miAccount and make sure your profile information is up-to-date and correct, especially your email address. We use email to quickly communicate a variety of information so keeping your email address up-to-date will ensure that you continue to receive these important messages from ORS. 
We will be sending information by email soon to public school employees who worked between July 2010 and September 2012 giving specific information about refunds of healthcare contributions. If you worked during this timeframe, please be sure to update your email address by January 15, 2018 to ensure that you will receive this important message.

How do I know if I have a refund coming? 

If you had reportable wages between July 2010 and September 2012, the 3% healthcare contribution during that period will be refunded.


When will I receive my refund?

The date of the refund will be announced when we have all the appropriate information regarding tax withholdings, retirement payments, etc.


What’s the best thing I can do right now to help the process?

The best thing you can do is confirm and/or update the contact information in your MiAccount making sure it is accurate and complete!  This will help both ORS and the district process your refund with the correct information.  You can access your account here: 

What if I’m retired?

If you worked anytime during July 2010 until September 2012, your 3% healthcare contributions during that period will be returned.  Please email your current contact information to the above email address.


What if I’ve left Clio schools?

The refund will be processed by the district you worked for during the mentioned dates.  If you worked for more than one district, make sure each district has your current contact information.  For Clio Schools please forward that information to the above email address.


How is the money refunded if the contributing member is deceased?

If you are a family member of a contributing employee whom is now deceased please leave your contact information at the above email to receive further information.


Why can’t the ORS send this directly to me instead of sending it to our employer?

There are taxation rules for these payments that can only be implemented by the employer.


How will this impact my taxes?

We do not have all the information at this time to answer this question.  As we obtain more information we will release it to you.  The business office will work diligently to make sure all the taxation rules are met.


Is interest included on these contributions?

Yes, interest will be included with the contributions when they are returned. The courts directed the administration to maintain the funds in a capital preservation escrow account, which accrues a very minimal amount of interest.
